Diese Bedingungen regeln den Fernabsatz \u00fcber die E-Commerce-Website www.backificio.com
\n(die \u201eWebsite\u201c) von Backwaren und anderen Lebensmitteln (\u201eProdukte\u201c) an Verbraucher (\u201eKunde\u201c).<\/p>\n

3. VERTRAGSSCHLUSS<\/strong><\/p>\n

Der Vertrag kommt zustande, sobald der Kunde die vom Verk\u00e4ufer versandte Bestellbest\u00e4tigungs-E-Mail erh\u00e4lt. Mit Abgabe der Bestellung erkl\u00e4rt der Kunde, diese Allgemeinen Gesch\u00e4ftsbedingungen gelesen und akzeptiert zu haben.<\/p>\n

4. PREISE UND ZAHLUNG<\/strong><\/p>\n

Alle Preise sind in Euro angegeben und verstehen sich inklusive MwSt. Die Zahlung erfolgt im Voraus und ist per Kreditkarte m\u00f6glich. Etwaige Versand- oder Bearbeitungskosten werden vor Bestellbest\u00e4tigung angezeigt.<\/p>\n

5. ABHOLUNG UND VERSAND<\/strong><\/p>\n

5.1 Abholung \u2013 Die Produkte k\u00f6nnen vom Kunden kostenlos an den auf der Website angegebenen Abholstellen abgeholt werden. Bei Abholung ist die Bestellbest\u00e4tigung vorzulegen.<\/p>\n

5.2 Versand \u2013 Nur nicht verderbliche Artikel, die als \u201eVersand verf\u00fcgbar\u201c gekennzeichnet sind, k\u00f6nnen per Kurier an die vom Kunden in Italien angegebene Adresse versendet werden. Voraussichtliche Lieferzeit: 2\u20135 Werktage ab Versandbest\u00e4tigungs-E-Mail.<\/p>\n

5.3 Der Verk\u00e4ufer haftet nicht f\u00fcr Verz\u00f6gerungen, die auf h\u00f6here Gewalt zur\u00fcckzuf\u00fchren sind, oder f\u00fcr Lieferverz\u00f6gerungen infolge falscher\/unvollst\u00e4ndiger Zustellangaben des Kunden.<\/p>\n

6. PRODUKTVERF\u00dcGBARKEIT<\/strong><\/p>\n

Bestellungen werden im Rahmen der Verf\u00fcgbarkeit ausgef\u00fchrt. Ist ein Produkt nicht lieferbar, erstattet der Verk\u00e4ufer den entsprechenden Betrag oder nimmt \u2013 nach vorheriger Absprache \u2013 einen Austausch vor.<\/p>\n

7. WIDERRUFSRECHT<\/strong><\/p>\n

Gem\u00e4\u00df Art. 59 Buchst. d) und e) des Gesetzesdekrets Nr. 206\/2005 (Verbrauchergesetzbuch) ist der Widerruf f\u00fcr verderbliche Lebensmittel ausgeschlossen. F\u00fcr andere Artikel kann der Kunde innerhalb von 14 Tagen ab Erhalt widerrufen, indem er seine Entscheidung per E-Mail mitteilt und die Ware unversehrt auf eigene Kosten zur\u00fccksendet; die Erstattung erfolgt innerhalb von 14 Tagen nach Eingang der R\u00fccksendung.<\/p>\n

8. GEW\u00c4HRLEISTUNG UND BESCHWERDEN<\/strong><\/p>\n

Die Produkte entsprechen den geltenden lebensmittelrechtlichen Vorschriften. Etwaige Beschwerden sind an info@backificio.com zu richten, unter Angabe der Bestellnummer und einer Problembeschreibung; der Verk\u00e4ufer antwortet innerhalb von 48 Stunden an Werktagen.<\/p>\n

9. HAFTUNG<\/strong><\/p>\n

Jegliche Haftung des Verk\u00e4ufers f\u00fcr indirekte Sch\u00e4den, entgangenen Gewinn oder F\u00e4lle h\u00f6herer Gewalt ist ausgeschlossen. Die Haftung f\u00fcr Vorsatz oder grobe Fahrl\u00e4ssigkeit bleibt unber\u00fchrt.<\/p>\n

11. ANWENDBARES RECHT UND GERICHTSSTAND<\/strong><\/p>\n

Der Vertrag unterliegt italienischem Recht. F\u00fcr Streitigkeiten mit Verbrauchern ist das Gericht am Wohnsitz des Verbrauchers zust\u00e4ndig; in allen anderen F\u00e4llen ist ausschlie\u00dflich das Gericht Bozen zust\u00e4ndig.<\/p>\n
